These Terms and Conditions (“Terms”) govern your access to and use of the ClipDart platform, including its website, mobile application, booking system, membership programs, and related services (collectively, the “Platform”) operated by ClipDart, Inc. and/or The ClipDart Giveback (“ClipDart,” “we,” “our,” or “us”).

By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to create an account. Minors may use the Platform only under the supervision of a parent or legal guardian who agrees to these Terms.

Users claiming senior status (55+) must provide valid government-issued identification at the time of service to verify eligibility. Failure to provide valid proof of age may result in denial of senior pricing, cancellation of related memberships, or immediate account adjustment.

2. Description of Services

ClipDart provides a digital platform that facilitates:

  • Booking and scheduling haircare services

  • Membership and subscription programs

  • Credit-based haircut plans

  • Event-based services

  • Digital communications

  • Payment processing

  • Donation processing

ClipDart reserves the right to modify, suspend, or discontinue services at any time.

3. Membership Plans & Credit System

Membership Tiers

ClipDart offers membership plans that may include:

  • Monthly haircut credits

  • Tiered pricing (Basic, Standard, Premium)

  • Senior (55+) discounted tiers

Pricing, benefits, and included credits vary by membership tier and are displayed at the time of enrollment.

Credit Policy

  • Membership plans include monthly haircut credits.

  • Credits never expire.

  • Credits may be shared with friends or family.

  • Credits used for cancelled appointments are automatically returned to the member’s account.

  • Credits have no cash value and cannot be redeemed for cash unless required by law.

  • ClipDart reserves the right to revoke credits obtained through fraud, abuse, or violation of these Terms.

Cancellation of Membership

  • Members may cancel their membership at any time.

  • Upon cancellation, unused credits remain in the member’s account.

  • Cancellation prevents future billing but does not remove previously earned credits.

  • ClipDart reserves the right to terminate memberships for policy violations.

4. Payment Terms

Billing

Membership fees are charged monthly on a recurring basis unless cancelled.

You may:

  • Update your payment method at any time.

  • Cancel automatic billing at any time prior to the next billing cycle.

Failure to maintain a valid payment method may result in suspension of membership benefits.

Refund Policy

Refunds are issued in accordance with:

  • The specific refund policy associated with the service purchased

  • Applicable state and federal laws

Except where required by law, membership fees already billed are non-refundable once the billing cycle has begun.

Third-Party Processors

Payments are processed through third-party providers. ClipDart is not responsible for payment processor errors, outages, or unauthorized transactions outside of our control.

5. Appointment Cancellation & Rescheduling

Members

  • Members may cancel appointments at any time without cancellation fees.

  • Credits used for cancelled appointments are returned to the member’s account.

Non-Members

  • Non-members may be subject to cancellation fees.

  • Cancellation fees, if applicable, are disclosed at the time of booking.

  • Repeated no-shows may result in account restrictions.

ClipDart reserves the right to cancel appointments due to safety concerns, professional unavailability, or operational conflicts.

6. Independent Service Providers

Unless expressly stated otherwise, hair professionals providing services through the Platform are independent contractors.

ClipDart does not:

  • Guarantee specific haircut outcomes

  • Guarantee availability of a particular professional

  • Assume liability for disputes between users and independent providers

Users are responsible for communicating their service preferences and relevant health information directly to their provider.

7. Acceptable Use

You agree not to:

  • Engage in fraudulent activity

  • Abuse membership credit systems

  • Falsely claim senior status

  • Circumvent payment systems

  • Harass professionals or other users

  • Use the Platform for unlawful purposes

  • Interfere with Platform security

ClipDart may suspend or terminate accounts for violations.

8. Intellectual Property

All Platform content, branding, logos, software, and design elements are the exclusive property of ClipDart and protected by intellectual property laws.

Unauthorized reproduction, distribution, modification, or commercial use is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by law:

ClipDart shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of data

  • Service dissatisfaction

  • Personal injury resulting from failure to disclose relevant health conditions

Total liability shall not exceed the amount paid by the user to ClipDart in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

ClipDart makes no warranties regarding:

  • Continuous availability

  • Error-free operation

  • Suitability for specific results

11. Termination

ClipDart may suspend or terminate accounts for:

  • Policy violations

  • Fraud

  • Abuse of credit systems

  • Failure to verify eligibility (including senior status)

Upon termination, outstanding balances remain due.

12. Governing Law

These Terms are governed by the laws of the State of Arizona.

Disputes shall be resolved in courts located in Maricopa County, Arizona, unless otherwise required by law.

13. Modifications

ClipDart may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
